Who pays the NJ realty transfer tax โ€” buyer or seller?

The seller (grantor) pays the Realty Transfer Fee at recording. Since July 10, 2025, the seller also pays the graduated percent fee (formerly the "mansion tax") on sales over $1 million. Both are closing costs deducted from the seller's proceeds.

How is the fee calculated?

The fee is charged per $500 of the sale price in graduated tiers: the rate rises as the price crosses thresholds. A $400,000 sale doesn't pay one flat rate on $400,000 โ€” it pays the lower-tier rate on the first $150,000, a higher rate on the next $50,000, and so on. Sales of $350,000 or less use a lower tier set; sales above $350,000 use a higher set across the whole price.

What is the graduated percent fee on sales over $1 million?

P.L. 2025, c. 69 replaced the old flat 1% mansion tax with a graduated percentage of the total sale price: 1% for $1Mโ€“$2M, 2% for $2Mโ€“$2.5M, 2.5% for $2.5Mโ€“$3M, 3% for $3Mโ€“$3.5M, and 3.5% above $3.5M. Unlike the tiered base fee, this one applies to the entire consideration, not just the amount over $1M. On a $1.2M sale it's a flat $12,000 on top of the base fee.

Do seniors or disabled sellers get a discount?

Yes โ€” sellers who are 62 or older, blind, or permanently disabled, and sales of low- or moderate-income housing, pay reduced rates on sales of $350,000 or less: $0.50 per $500 on the first $150,000 and $1.25 per $500 above that. The reduced schedule does not apply to sales over $350,000.

Is the realty transfer fee the same as NJ's exit tax?

No. The "exit tax" people talk about is really the Gross Income Tax nonresident withholding โ€” 2% of the sale price withheld when a nonresident sells NJ property. It's a prepayment of income tax, not the same as the Realty Transfer Fee, and residents who move out of state can be caught by it too.

What about recording fees on top of this?

County clerks charge recording fees (roughly $30 for the first page and $10 per additional page) plus per-document fees, and some counties add their own charges. These are small relative to the transfer fee but show up as separate line items at closing โ€” this calculator covers the state transfer taxes only.
